In our state, if you have been arrested for DUI, the Division of Motor Vehicles (DMV) will commence a civil administrative hearing against you to seek the revocation of your driver's license. You will have 7 days, from your arrest date, to schedule a DMV hearing to fight the charges and try to avoid the suspension or revocation.
This hearing is basically a trial where the police officer that arrested you will testify against you to try and prove that he or she had reasonable suspicion to stop your vehicle, had probable cause to arrest you for DUI, that any breathalyzer or blood tests administered were done legally, that they were accurately administered, that you were indeed above the legal limit (.08 or higher) and that you were advised of your legal rights when you were arrested.
This is a lot to prove during a short hearing, and if there are any issues in question or that fail to get proven, the action to suspend or revoke your driving privileges will likely be dismissed.
